General Terms and Conditions Hagon Shocks Benelux, part of Wheeler Dealer Import BV

To avoid misunderstandings, we ask you to take the time to read these terms. These terms govern the agreement between us. They form the basis for how you use our website, purchase our products, what we deliver, what we charge, and what we require from you. By submitting a request and/or order to Hagon Shocks Benelux, you agree to these terms and our privacy policy. These terms apply to every purchase you make on this website from Hagon Shocks Benelux.

1. Definitions

1.1 In these general terms and conditions ("the terms"), the following words and phrases, unless the context requires otherwise, have the following meanings:

  • “Customer Material” means all information provided by the customer to Hagon Shocks Benelux, including but not limited to your data, measurements, delivery details, requirements, or information provided in the request or order;

  • “Request” means any request made to Hagon Shocks Benelux;

  • “Force Majeure” includes any delay or failure to meet our obligations under these Terms if such delay or failure results from circumstances beyond our reasonable control, including (but not limited to) force majeure, communication failures, death, destruction, fire, flood, strikes, riots, accidents, power outages, civil unrest, terrorist attacks, or acts of war;

  • “Order Confirmation” means an order confirmation from Hagon Shocks Benelux to you confirming receipt of your payment and acceptance of your order;

  • “Price” means a price provided to you by Hagon Shocks Benelux following an order confirmation and/or a request;

  • “Product” means products for sale on the website;

  • “Hagon Shocks Benelux”, “us” or “we” means Hagon Shocks Benelux, part of Wheeler Dealer Import BV (Chamber of Commerce Number 97782041), based in Barneveld;

  • “Website” means the website for the sale of products at www.hagonshocks.nl;

  • “In Writing” includes email, fax, or other similar means of communication;

  • “you”, “your” or “customer” means the person, firm, or company placing an order for products with Hagon Shocks Benelux.

2. Product Details

2.1 Products displayed on this website are not shown at actual size, and images are not binding in terms of details. Some products may appear slightly larger or smaller than actual size due to screen errors or photographic techniques. Some products may be displayed larger to show details or smaller to show the full item. You are advised to check product details where indicated. If the product you receive materially differs from the listed product details, you have the right to refuse it without penalty.

2.2 All products are subject to availability. In the unlikely event that specifications or quality of the ordered goods change, we will contact you and offer a replacement product or refund your order.

3. Product Prices

3.1 Subject to clauses 3.4 and 3.5, the price of products is as listed on our website at the time you place your order.

3.2 Prices on the website include VAT but exclude shipping costs and insurance during transport. These costs depend on the value of purchased items and are added at checkout.

3.3 All products must be fully paid before shipment.

3.4 Prices on our website may vary due to factors beyond our control or if there is a delay between ordering and receiving an order confirmation. In these cases, you have the right to cancel your order if the price increase is unacceptable to you.

3.5 Notwithstanding clauses 3.4 or 6.1.1, we will contact you to resolve the situation if a pricing error is discovered.

3.6 Prices may be displayed in different currencies but will be invoiced in Euros.

4. Requests

4.1 By submitting a request, you are not obligated to purchase a product, but you agree to be bound by these terms and our privacy policy.

5. Order Acceptance and Payment

5.1 Before your order can be accepted, we must receive the full listed purchase price (without any deduction) in cash or confirmation of payment authorization (if using a credit card).

5.2 Upon receiving your order, we will send a receipt confirmation. Once payment is received according to 5.1, we confirm acceptance of your order by sending an order confirmation to your provided email. At this point, a legally binding agreement exists between us.

5.3 You must pay for products via the methods currently listed on the website, including but not limited to:

  • Bank transfer to the Hagon Shocks Benelux account.

5.4 If payment is not received, or you are not authorized to use the payment method, or there are insufficient funds:

  • We may contact you to request payment within a set period via the same or another method; or

  • We may cancel your order at our discretion and refund all received amounts within 30 days, potentially charging administration fees;

  • You agree that Hagon Shocks Benelux is not liable for any loss, damage, costs, or claims resulting from failed payment.

5.6 You agree to fully indemnify Hagon Shocks Benelux for all costs incurred in collecting payments in case of failed payment.

6. Our Right to Cancel

6.1 We reserve the right to cancel your order if:

  • A pricing error is discovered before sending the order confirmation;

  • Force majeure occurs.

6.2 If canceled, we will notify you by email and offer a replacement product or refund all payments within 30 days.

6.3 We are not liable for loss or claims arising from canceled orders before sending the order confirmation.

6.4 Clause 6 does not affect your statutory consumer rights.

7. Delivery

7.1 We may charge for and split orders if multiple items are in the order confirmation.

7.2 Delivery occurs to the address listed in the order confirmation.

7.3 We take reasonable steps to deliver on or before the stated date but are not liable for delays beyond our control.

7.4 You become the owner of products upon delivery. After delivery, the products are at your risk.

8. Right of Withdrawal

8.1 Except for custom-made products, you may cancel your order in writing according to clause 10. No reason or fee is required.

9. Warranties and Returns

9.1 We guarantee products of satisfactory quality under the following conditions:

  • Hagon Shocks Benelux is not liable for defects due to misuse, negligence, modifications, or provided customer materials.

  • You can contact us via post, website contact form, or phone (9:00–17:00).

9.2 Products must meet or exceed expectations. Notify us as soon as reasonably possible for issues.

9.3 If a problem is reported, we will:

  • Offer a replacement product within 60 days, or

  • Arrange return and refund according to clause 10.

10. Returns Procedure

10.1 To return a product:

  • Contact customer service for a return authorization number;

  • Package product and all original materials in a box;

  • Write your name and address and send to:
    Hagon Shocks Benelux, Wilhelminastraat 100, Barneveld;

  • Insure the package for its full value; we are not liable for loss during shipping.

10.1.5 Returns must be:

  • At your expense unless otherwise agreed;

  • In original condition, unused and undamaged.

10.2 Refunds are made in the original payment method.

10.3 Returns are processed after inspection, usually within five business days.

11. Website Use

11.1 Use the website only for lawful purposes.

11.2 We are not liable for third-party information errors.

11.3 We do not guarantee uninterrupted or error-free operation.

11.4 Website information may contain technical errors and may change without notice.

11.5 All information received from you will be handled according to our privacy policy.

11.6 Links to third-party websites are not guaranteed.

12. Liability

12.1 We are not liable for third-party information errors.

12.2 We will make reasonable efforts to reschedule delivery if delays occur.

12.3 Force majeure relieves us of obligations.

12.4 Our liability is limited to the value of the order.

12.5 We are not liable for indirect, special, or consequential damages.

12.6 You must comply with all applicable laws, including import/export restrictions.

13. Notices, Questions, and Complaints

14. Intellectual Property

14.1 All website content is owned by Hagon Shocks Benelux.

14.2 Intellectual property rights for products belong to Hagon Shocks Benelux.

14.3 You guarantee that customer material does not infringe third-party rights.

15. Privacy Policy

15.1 You agree to be bound by our privacy policy.

16. General

16.1 These terms apply exclusively unless expressly agreed otherwise.

16.2 We may amend terms; continued use constitutes acceptance.

16.3 Typographical errors may be corrected without liability.

16.4 Invalid provisions do not affect the rest of the terms.

16.5 These terms, prices, delivery, contact, and privacy form the entire agreement.

16.6 Governed by Dutch law; exclusive jurisdiction of Dutch courts.

16.7 We may transfer or assign our rights.

17. Warranty

17.1 2-year suspension warranty: justified claims are handled at our discretion by repair or replacement.

Exclusions: misuse, wear, mechanical/chemical influence, force majeure, or third-party interventions.
